Motorfax provides vehicle inspection reports based on information compiled from various third-party data providers. The report is a summary of publicly available and proprietary data sources, presented for your convenience.

2.1. Accuracy of Information

While we strive to provide the most accurate and up-to-date information, the data in our reports is sourced from third parties. We do not independently verify the accuracy or completeness of all information. Therefore, we do not guarantee the completeness, accuracy, or currency of the data provided and are not liable for any errors or omissions. The report should be used as a guide and is not a substitute for a professional vehicle inspection.

2.2. No Warranty

Our reports and services are provided on an "as-is" and "as-available" basis. We make no warranties, whether express or implied, regarding the reports, including, but not limited to, any warranty of merchantability, fitness for a particular purpose, or non-infringement.

2.3. User Responsibility

You are solely responsible for the accuracy of the information you provide to generate a report, including the vehicle registration number or VIN. It is your responsibility to verify all information in the report and to conduct your own due diligence before making any decisions, including vehicle purchases.

3. Payments

All payments for our services are processed securely through Tyl by NatWest, a third-party payment gateway. We do not handle, store, or have access to your sensitive credit card information. By submitting your payment details, you consent to your data being handled in accordance with the terms and conditions and privacy policy of Tyl by NatWest.

4. Refund Procedure

Given the digital nature of our service, our refund policy is designed to be fair and transparent. We will issue a full refund in the following circumstances only:

4.1. Eligible for Refund

• Report Not Delivered: If you successfully complete your payment but do not receive your vehicle inspection report via email within a reasonable time frame (typically within 15 minutes). We will first attempt to resend the report; if the issue cannot be resolved, a full refund will be issued.
• Report Does Not Match Vehicle: If the report you receive is for a vehicle other than the one you entered and paid for.
• No Data Found: In the event that our data providers are unable to find any information for the vehicle registration number or VIN you submitted.

4.2. How to Request a Refund

To request a refund, you must contact us at inquiry@motorfax.co.uk with the following information:

• Your full name and email address used for the purchase.
• The vehicle registration number or VIN submitted.
• The date and time of the transaction.
• A detailed explanation of the reason for your refund request.

We will review your request and respond within a reasonable timeframe. Refunds will be processed back to the original payment method. Please allow a few business days for the refund to appear in your account, as processing times vary by bank and card issuer.

5. Limitation of Liability and Indemnification

5.1. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, resulting from:

• The use or inability to use our service;
• The accuracy or inaccuracy of the information in the vehicle reports;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of our service.

5.2. Indemnification

You agree to indemnify, defend, and hold harmless Motorfax, its affiliates, and their respective directors, officers, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

6. Intellectual Property and Acceptable Use

All content on our website and in our reports, including text, graphics, logos, and the reports themselves, is the property of Motorfax or its content suppliers and is protected by copyright and intellectual property laws.

6.1. Permitted Use

The report is intended for your personal, non-commercial use only. You may download and print a copy for your own records.

6.2. Prohibited Use

• Reselling, redistributing, or otherwise commercially exploiting the report.
• Creating derivative works from the report or website content.
• Using our service or website for any fraudulent or illegal activity.
• Attempting to reverse engineer, hack, or otherwise interfere with the security or functionality of our website or service.
